Nxt Level Fitness LLC (dba Just Elevate) Liability Waiver

Release of Liability, Assumption of Risk, and Indemnity Agreement

In consideration of being allowed to participate in any way at Nxt Level Fitness LLC ("the Gym"), located at 1583 Franklin St. Detroit, MI 48207, the undersigned acknowledges, understands, and agrees to the following:

1. Acknowledgment of Risk

   - I am aware that participating in physical fitness activities and using exercise equipment involves inherent risks, including but not limited to, muscle injuries, sprains, strains, fractures, cardiovascular complications, or other physical injuries that may arise from participation.

   - I understand that even with the most stringent safety protocols, risks such as equipment failure, accidents, or negligence by other participants cannot be entirely eliminated.

2. Assumption of Risk

   - I voluntarily choose to participate in activities and use the facilities at the Gym, understanding that such participation carries potential risks of injury or even death.

   - I assume full responsibility for any and all risks, whether known or unknown, that are related to my participation in physical fitness activities at the Gym.

3. Release and Waiver

   - I hereby release, waive, discharge, and covenant not to sue Nxt Level Fitness LLC, its owners, officers, employees, trainers, agents, and representatives (collectively referred to as "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me while participating in activities or using the facilities at the Gym.

   - This release applies regardless of whether such liability arises from negligence, breach of contract, or any other legal theory.

4. Indemnity Agreement

   - I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and attorneys' fees, that may arise from my participation or use of the facilities.

5. Medical Clearance

   - I confirm that I am in good health and have no medical condition that would prevent safe participation in physical activities. I understand it is my responsibility to consult with a physician before beginning any exercise program or using any equipment at the Gym.

6. Use of Equipment and Facilities

   - I agree to use the equipment and facilities in accordance with their intended purpose and to follow any rules, instructions, or safety guidelines provided by the Gym or its staff.

7. Photography and Media Release

   - I consent to the use of photographs, videos, or recordings taken of me while at the Gym for marketing, promotional, or educational purposes without any compensation or prior notice.

8. Severability

   - I agree that if any portion of this agreement is found to be unenforceable or void by a court of competent jurisdiction, the remaining sections shall remain in full force and effect.

9. Binding Agreement

   - This waiver is binding upon myself, my heirs, executors, administrators, and assigns.

10 . Cancellation 

   - By signing this you agree and acknowledge that all monthly gym memberships must be cancelled 30 days in advance. If member(s) fail to cancel within said time frame the account will be renewed and remain active until the following month - where the cancellation request will be fulfilled.  

I acknowledge that I have read, understood, and voluntarily agree to this Liability Waiver. I further agree that no oral representations, statements, or inducements apart from this written agreement have been made.
